Welcome to LuvMugs (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of our Shopify storefront, products, and services (collectively, the “Service”). By visiting our site or purchasing from us, you agree to be bound by these Terms and our other posted policies (including our Privacy Policy and Return & Refund Policy). If you do not agree, please do not use the Service.

1) Store Eligibility & Account Responsibilities
• You must be at least the age of majority in your state or province to use the Service.
• If you create an account, you’re responsible for maintaining the confidentiality of your credentials and for all activities under your account.

2) Product Information & Availability
• We offer print-on-demand coffee mugs and related items. Designs may vary slightly due to screen settings, print tolerances, and production methods.
• Product availability, designs, colors, and pricing may change at any time without notice. We may discontinue any product at any time.
• Content referencing affirmations, angel numbers, or metaphysical themes is for inspiration and entertainment only and is not a guarantee of any outcome.

3) Pricing, Taxes & Currency
• Prices are listed in USD unless otherwise stated. We reserve the right to modify prices without notice.
• Applicable taxes, duties, and fees are calculated at checkout or charged upon import (for
international orders). You are responsible for any customs or import duties.

4) Orders, Acceptance & Cancellations
• Submitting an order is an offer to buy; we may accept or reject any order for any reason (including suspected fraud, inventory issues, or pricing errors).
• Because we use on-demand production, changes or cancellations may not be possible once your order is in production. Contact us as soon as possible and we’ll do our best to help.

5) Production, Shipping & Delivery
• Processing and shipping timelines shown at checkout are estimates and can vary due to carrier delays, weather, holidays, or high-volume periods.
• Risk of loss transfers to you upon delivery to the carrier. Please provide accurate shipping details; we are not responsible for delays or losses due to incorrect addresses.
• International shipping (if offered) is available only to select countries. Additional customs fees may apply and are your responsibility.

6) Returns, Exchanges & Damages
• Please review our Return & Refund Policy for full details.
• If your order arrives damaged, incorrect, or defective, contact us within the timeframe listed in our policy with photos of the issue and packaging. We’ll investigate and make it right where
appropriate.

7) Product Care & Use
• Many mugs are labeled by the manufacturer as dishwasher- and microwave-safe; actual results can vary by appliance, detergent, heat setting, and use. Hand-washing may extend print life.
• Always check product descriptions and care notes before use.

8) Customization & User Content
• If you submit custom text, images, or design requests (“User Content”), you represent that you own or have permission to use that content.
• You agree not to submit content that infringes intellectual property, contains hate speech, illegal material, or violates these Terms.
• We may refuse or cancel orders containing prohibited or infringing content.

9) Intellectual Property
All LuvMugs designs, product photography, text, and branding are protected by intellectual property
laws. You may not reproduce, resell, or commercially exploit our content without prior written consent.

10) Third-Party Services & Links
• We use third-party providers (e.g., payment processors, print partners, shipping carriers). Your use of those services may be subject to their terms and policies.
• We are not responsible for third-party websites or services linked from our store.

11) Prohibited Uses
• For unlawful purposes or to solicit others to perform unlawful acts;
• To violate any international, federal, state, or local regulations;
• To infringe upon or violate our or others’ intellectual property rights;
• To harass, abuse, insult, harm, defame, intimidate, or discriminate;
• To submit false or misleading information;
• To upload viruses or malicious code;
• To collect or track personal information of others without consent;
• To spam, phish, pharms, pretext, spider, crawl, or scrape;
• To interfere with or circumvent security features of the Service.

12) Accuracy, Completeness & Errors
Occasionally there may be information on the site that contains typographical errors, inaccuracies, or omissions (e.g., pricing, availability, shipping times). We reserve the right to correct errors, change or update information, or cancel orders if any information on the Service is inaccurate at any time without prior notice.

13) Modifications to the Service & Prices
We may modify or discontinue the Service (or any part or content) without notice at any time. We are not liable for any modification, price change, suspension, or discontinuance.

14) Personal Information & Privacy
Your submission of personal information through the store is governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your data.

15) Disclaimer of Warranties
The Service and all products delivered to you are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement. Your use of the Service is at your sole risk.

16) Limitation of Liability
• To the maximum extent permitted by law, LuvMugs and our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors shall not be liable for any indirect, incidental, punitive, special, or consequential damages; loss of profits, revenue, savings, data, or replacement costs; or any similar damages arising from your use of the Service or any products procured using the Service.
• In all cases, our total liability shall not exceed the amount you paid for the product(s) at issue.

17) Indemnification
You agree to indemnify, defend, and hold harmless LuvMugs and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms or your violation of any law or third-party rights.

18) Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be deemed severed from these Terms and shall not affect the validity and enforceability of any remaining provisions.

19) Termination
These Terms are effective unless and until terminated by either you or us. If in our sole judgment you fail to comply with any term or provision, we may terminate your access to the Service at any time without notice, and you remain liable for all amounts due up to and including the date of termination.

20) Governing Law
These Terms and any separate agreements whereby we provide you the Service shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict-of-laws principles.

21) Changes to Terms
We may update these Terms from time to time. The “Last updated” date at the top will reflect the most recent changes. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

22) Channel-Specific Note
We also sell on platforms such as Etsy, TikTok Shop, and Amazon. Purchases made on those platforms are additionally subject to the terms and policies of those respective marketplaces. This Terms of Service applies to purchases made directly through our Shopify store.
